On an objection raised by the learned APP that the present application is not maintainable under Section 439 of the Code of Criminal Procedure, as the applicant is not in jail, Shri Naik, learned counsel for the applicant submits that the accused may be permitted to surrender before the learned Trial Court and apply afresh for grant of bail.

However, he make a request that in the light of the order passed by the Hon'ble Supreme Court of India, the learned Trial Court may be directed to decide the application within a stipulated period.

In the above referred backdrop, I permit the applicant to withdraw the present application with liberty to file a fresh application before the learned Trial Court.

The applicant shall surrender before the learned Trial Court on 28/06/2022. If the applicant provides copy of application for grant of bail to the concerned learned APP, two days in advance, the learned trial Court is requested to decide application within three days.
