Prayer is to stay the decree passed by the first appellate Court awarding damages of Rs. 1,80,000/- in favour of the respondent. It is stated that the applicant has a good case on merits and hence the decree deserves to be stayed.

The request is opposed on the ground that the decree in question is a money decree. If the applicant deposits a sum of Rs.1,25,000/- in this Court within a period of six weeks from today, the decree passed by the first appellate Court shall remain stayed. If such amount is deposited, the same would be invested in Fixed Deposit.
