On instructions from the petitioner, learned Advocate for the petitioner makes a motion to withdraw the petition with liberty to take recourse to appropriate remedy of filing a fresh suit or filing application for restoration of Regular Civil Suit No.17/2021 which was dismissed for want of prosecution on 03/11/2022.

The writ petition is allowed to be withdrawn with liberty as prayed. However, all objections with respect to maintainability of fresh suit as also application for restoration are kept open.

No order as to costs.
