DATE : 16 th JUNE, 2020 Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.
02] Heard the learned Counsel for the applicant and the learned A.P.P. for the State.
03] The application for regular bail of the applicant came to be rejected by the Sessions Court, Akola as per order dated 01/06/2020. The applicant was working as Talathi and he was trapped while accepting Rs.700/- bribe amount. The trial Court rejected his bail application for the reason that his grievance about medical ailment was not supported by any document on record.
04] Considering the short controversy involved, I have taken up this application for hearing, even though reply is not filed. The learned A.P.P. has
ba.283.20 2/2 consented for the same, but strongly opposed for grant of bail.
05] Considering the nature of allegations, custodial interrogation of the applicant is no more required. The applicant being a public servant, I think, he needs to be released on bail. Hence, the order :
O R D E R
I.
The application is allowed.
II.
The applicant be released on bail on furnishing P.R. Bond and Surety Bond of Rs.25,000/-.
III.
The applicant is directed to attend the OfÏce of Anti Corruption Bureau, Akola on every Monday and Thursday from 10:00 a.m. to 12:00 noon till filing of the charge-sheet.
IV. Applicant is directed not to tamper with the prosecution witnesses.
V.
The application is disposed of.
VI.
This order be communicated to the learned Counsel appearing for the parties, either on the email address or on WhatsApp or by such other mode, as is permissible in law.
