CORAM : B.P. DHARMADHIKARI & A.P. BHANGALE, JJ.
FEBRUARY 25, 2015.
Heard Shri Khati, learned counsel for the petitioners, Shri Thakare, learned counsel for respondent No. 1 and Shri Kale, learned AGP for respondent Nos. 2 & 3.
Shri Thakare, learned counsel states that he is awaiting instructions on merits.
Shri Khati, learned counsel is opposing any adjournment. He points out that after policy decision, as communicated by the State Government on 21.02.2011, the petitioners have made a representation on 05.03.2014 and 25.02.2014 in respective petitions and no decision has been taken on that representation till date.
Shri Thakare, learned counsel disputes this.
The petitioners have come up with a specific case that no decision has been taken on their representation. This Court has issued notice on
2502wp2332.14 20.06.2014 and thus a period of more than eight months has already expired.
In this situation, as the petitioners claim deemed date that too on the basis of subsequent policy decision, interests of justice can be met with by directing Respondent No. 1 to take suitable decision on the petitioners representation within a period of three months from today. If necessary the petitioners shall be extended an opportunity of hearing.
With these directions and keeping all rival contentions open, we dispose of the present writ petitions. However, there shall be no order as to costs. JUDGE JUDGE *GS.
