The applicant is said to be arrested on 30/12/2017 in connection with Crime No. 176/2016 registered at Police Station Dhamangaon Badhe for the offence punishable under Sections 302, 504 and 506 read with Section 34 of the Indian Penal Code and Sections 4 and 25 of the Arms Act, 1959.

Mrs. Gadhawe, learned counsel for the applicant, submits that the applicant is behind the bar since about three years. She further submits that as the applicant was having old enmity with the deceased, he has been falsely implicated in the instant case, and thus prayed for releasing the applicant on bail.

Learned A.P.P. opposed the bail application through the reply affidavit filed on record.

From perusal of the application and the reply affidavit it appears that it is a case of double murder. The weapons used for committing the crime are 'Sword' and 'Iron Pipe'
. The injuries were on the vital part of the deceased. The cause of death is severe head injury. It appears that the applicant along with the co-accused Dilip Singh, in furtherance of their common intention, inflicted severe injuries on the deceased.

Considering the nature of offence and the accusations levelled against the present applicant, this Court is of the opinion that he does not deserve bail at this juncture. Hence, the same is rejected.

Fees of the Advocate (appointed) for the applicant is quantified at Rs.2,000/- (rupees two thousand only).
