The applicant is working as primary school teacher and admittedly he has only one son i.e. non applicant who is also taking education. The applicant has approached this Court against an order passed by the Family Court, Amravati enhancing amount of maintenance to Rs.4000/- per month payable to non applicant.

Looking to the fact that the non applicant is son of applicant and looking to the paying capacity of the applicant, who is working as teacher in Zilla Parishad School, I think, there is no need to interfere in the impugned order.

At this stage, learned counsel for the applicant submits that condition nos. 3, 4 and 5 of the impugned order are comprehensive. They relate to the mode of payment of maintenance and hence should be modified.

revn54.15 I think, the applicant shall approach the Family Court for suitable modification, if any, in the mode of payment.

In view of above, I pass the following order:

ORDER

(i) Criminal Revision Application No.

54/2015 is disposed of.

(ii) Liberty is reserved in favour of the applicant to approach the Family Court, Amravati for modification in mode of payment of maintenance. If the applicant approaches to the the Family Court, Amravati for modification, it shall consider the same after hearing the parties.
