It is submitted by learned counsel for appellant that in the connected appeal as the private paper-book was filed, appellant has not filed private paper-book in this case. As a result thereof, the appeal came to be dismissed for default. Hence, this application for condonation of delay and the application for restoration of appeal. In view of the fact that the evidence recorded in this appeal and in First Appeal No.754/2010 is common and already the private paper-book is filed in First Appeal No.754/2010, the filing of the private paper-book is dispensed with in this appeal.

Hence, in the interest of justice the application for condonation of delay and the application for restoration of appeal are allowed with no order as to costs. JUDGE NSN
