The petitioner has approached this Court praying for a direction to respondents to appoint petitioner against a post reserved for physically challenged person.

Minimum qualifying marks for being entitled to be appointed is 45% i.e. 90 out of 200. The petitioner has secured only 86 marks.

Apart from that the post of physically challenged person as reserved in horizontal reservation falls for Special Backward Class under the vertical reservation. The petitioner does not belong to Special Backward Class but belongs to Other Backward Class. As such he also does not qualify requirement of vertical reservation.

In that view of the matter, we do not find that prayer as made in the petition can be granted. Petition is, therefore, rejected.
