IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO.2600 OF 2024 [Atin S/o Manohar Bhendkar VERSUS The Union of India, through its Secretary, Ministry of Railways, New Delhi and others] Office Notes, Office Memoranda of Coram, appearances, Court'

s orders of directions Court' s or Judge'

s order and Registrar'

s orders.

Shri R.M. Pande, Counsel for Petitioner.

Shri S.A. Chaudhari, Counsel, holding for Shri N.S. Deshpande, Deputy Solicitor General of India for Respondent Nos.1 to 3.

CORAM : NITIN W. SAMBRE AND ABHAY J. MANTRI , JJ .

ATE : 5 th JULY, 2024 1.

The petitioner is informed to have been served with the termination order. 2.

The challenge in this petition is to the chargesheet issued to the petitioner. 3.

In this background, Shri R.M. Pande, learned counsel for the petitioner, seeks leave to amend the petition to question the termination order served on the petitioner.

4.

It is not in dispute that against the order of termination, the alternate remedy of approaching the Central Administrative Tribunal is available to the petitioner.

5.

That being so, we deem it appropriate to dispose of the present petition with liberty to the petitioner to approach the Central Administrative Tribunal questioning the order of termination. It is ordered accordingly. 6.

Needless to clarify that this Court has not appreciated the merits of the matter.
