In view of above and for the reasons set out in the application, the application is allowed.

Amendment be carried out within one week. The petitioner shall add applicant as party - respondent No. 2. Once the amendment is carried out, issue notice to the newly added respondent No. 2.

Mr. N. R. Jadhav, learned counsel waives service of notice for respondent No. 2.

The application is disposed of.

The respondents may file reply, if so desired, failing which, the petition shall proceed without reply.
