APRIL 27, 2018 Heard. Perused the reply of the prosecution and the case diary.

It is not in dispute that this applicant was not present at the spot of the incident at the relevant time and the only material available against him is about the mobile contact between him and the coaccused. There is, however, no offence of criminal conspiracy against all the accused persons and all the offences have been registered against all the accused persons with the aid of Section 149 of IPC.

In view of above, I find that this is a fit case for grant of anticipatory bail. The application is, therefore, allowed. Ad-interim anticipatory bail granted by this Court on 6th April, 2018 is hereby confirmed on the same conditions with clarification

ABA236.18 that the applicant need not attend the police station except when he is called upon to do so by the Investigating Officer.

The application stands disposed of accordingly.
