The present application has been moved by the original plaintiff praying that time be extended to decide Special Civil Suit No.216/2012. In the application, it has been stated that by order dated 14-3-2014 the trial Court had been directed to decide the suit within a period of ten months. However, by subsequent orders, this time was extended and the trial Court was expected to decide the suit by the end of March, 2016. It is further stated that the Counsel for the original plaintiff was not in a position to conduct the case for medical reasons and therefore, another Counsel has been engaged.

The application is opposed by the learned Counsel for the defendant on the ground that by order dated 14-3-2014 after noticing the urgency, the proceedings were expedited. The learned Counsel states that as the side of the plaintiff is now closed, the defendant would lead evidence and if any extension is granted, the same may be for a short

Considering the averments made in the application the time to decide Special Civil Suit No.216/2012 is extended till 15th of July, 2016. The application is disposed of.

It is expected that the parties shall co-operate with the trial Court for disposal of the suit within the time as extended.
