The present application is filed for condonation of 53 days' delay in filing Second Appeal.

It is submitted that the applicant is a trust and the office bearer of the trust is required to take the decision in consultation with all members of trust.

Though the learned counsel for the respondent opposed the application, I am with the considered opinion that there is no intentional or deliberate delay in filing Second Appeal and the delay is caused for justifiable reasons. As such, the application is allowed. Delay in filing Second Appeal is hereby condoned. 4.

Registry is directed to register Second Appeal. 5.
