DATED : 19-04-2017 The learned Counsel for the applicant seeks permission to withdraw the application with liberty to move before the reference Court with same prayer. The application is withdrawn with liberty as prayed for.

The reference Court is directed to decide the said application if moved for withdrawal of the amount deposited before it, after considering the similar order passed in other first appeals without being influenced by the fact that the appeal is pending before this Court. First Appeal No.653/2016.

The appellant shall file private paper-book within a period of six months from today, failing which the appeal shall stand dismissed without reference to the Court.
