DATED : 02/05/2019 Heard learned Advocate Shri Deshpande for the applicant. He has submitted that applicant was already released on bail during the pendencey of the proceeding before the trial court. He did not attend the trial court and, therefore, nonbailable warrant was issued. Meanwhile, the applicant himself appeared before the trial court and prayed to cancel non-bailable warrant. Instead, cancelling non-bailable warrant trial court rejected his application and taken him on custody on 15.01.2019. 2.

Shri Chutke, learned Additional Public Prosecutor for the State/respondent has strongly objected the present application.

Applicant was already on bail. Hence, the following order.

Criminal Application is allowed.

The applicant be released on bail on his executing a P.R. Bond in the sum of Rs.15,000/- with one solvent surety of like amount on the following conditions.

(b) If the applicant remains absent on a single date, trial court would be at liberty to take the applicant in custody or cancel the bail.
