On the previous date of hearing, a statement was made by the learned counsel for the appellant that the matter is settled between the parties and that the counsel would take instructions in that regard. At the request of the learned counsel, the family court appeal was adjourned and was directed to be listed at Sr.No.1 on the final hearing board by way of a last chance, as none had appeared on behalf of the appellant on the two earlier dates of hearing. None appears for the appellant today. We find that the present appeal is filed against the judgment of the Family Court directing the appellant to pay a sum of Rs.3,000/- per month for the respondent and her minor son. The judgment of the Family was not stayed by any interim order, in this appeal. The respondent must have executed the decree passed by the Family Court. It appears that the appellant is, therefore, not interested in prosecuting the family court appeal. The Family Court appeal is dismissed for want of prosecution.
