After hearing learned counsel for the applicant for some time and expressing that the Court is not inclined to grant bail, learned counsel for the applicant prays for withdrawal of the present application and expedite the trial before the learned trial Court.

Permission is granted to withdraw the present application.

Considering the Roznama, wherefrom it can be seen that on some dates though the witnesses were present, they were not examined, the learned trial Court has observed in its order while rejecting the bail application of the applicants that, only after August-2021, the Court started its regular functioning, which got slowed in the month of January-2022, because of the outbreak of rkn

40-ba-544-2022.odt "Omicron Virus". Be that as it may, considering the fact that, the trial has already commenced. The learned trial Court is requested to expedite the trial and conclude the same on or before 20/02/2023.

The applicant shall communicate this order to the learned trial Court within one week from today. 5.

Subject to above condition, liberty is granted to the applicant to apply afresh, in case, there will be no substantiate progress in the trial till 28/02/2023. The criminal application is disposed of as withdrawn.
