DATED : JULY 5, 2019 Ms. Khobragade, learned Counsel for petitioner, orally seeks leave to delete prayer clause (ii) of the petition contending that order dated 21/4/2018 of which quashment is sought is with regards to some other convict.
Leave as prayed is granted. Amendment be carried out forthwith.
The limited prayer in the petition is to direct respondents to give remission to petitioner in view of Government Resolution dated 3/6/2017.
The petitioner is found to have completed 15 years of actual imprisonment and is accordingly found entitled for the said relief. However, relief appears to have been not granted to petitioner as no opinion is received from 2nd Additional Sessions Judge, Nagpur in spite of communication dated 15/4/2019 sent to said

In that view of the matter and since sufficient time has already lapsed, we direct learned 2nd Additional Sessions Judge, Nagpur to give his opinion within a period of three weeks from the date of receipt of this order. On submission of same, respondent Authorities shall duly consider the prayer of petitioner for grant of remission on account of 125th birth anniversary of Dr. Babasaheb Ambedkar in view of Government Resolution dated 3/6/2017.
The petition is disposed of in the above terms.
