This is an application filed by the applicant-respondent no.1 for withdrawal of an amount deposited by the appellant in pursuance to the order dated 15.2.2017 passed by this court.

Heard the learned counsel for the parties. Perused the contents of the application.

It is stated that First Appeal No.1175/2017 has been withdrawn by the appellant and as such it is disposed of and therefore respondent no.1 prays for withdrawal of the amount deposited by the appellant in this court.

In view of the fact that the appeal is already withdrawn, I am inclined to allow the said application. Hence the order. The applicant-respondent no.1 is allowed to withdraw the amount deposited by the appellant in this court. The application stands disposed of accordingly. JUDGE Gulande
