Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

The applicant is apprehending arrest in Crime 170/2020 registered with Rana Pratap Nagar Police Station, Nagpur for offence punishable under sections 120(B), 406, 408, 420, 465, 467, 471 of the Indian Penal Code and sections 43 and 66 of Information Technology (Amended) Act, 2008.

The complainant one Vinodkumar Tambi of Excellon Software Pvt. Ltd. lodged a report against co-accused one Shatrughnasingh Tangral, who was then working as Vice-President in Excelleon Software Pvt. Ltd.. The gist of the report is that Shatrughnasingh Tangral caused to outsource some work to one Bizcloud Corporation without disclosing that he was a partner of the
said firm. It is then alleged that the present applicant accepted the assignment outsourced by Bizcloud Corporation. The allegation is that the present applicant exceed the brief and entered into a conspiracy to extract/extort money.

It is admitted position that although the applicant was not enjoying interim protection, he has attended the Police Station and has cooperated with the Investigating Officer, during the pendency of the application. Considering the nature of allegations and the material on record, the applicant has made out a case for grant of pre-arrest bail. In all fairness, there is no serious opposition from the prosecution and the submission is that the applicant should makes himself available for interrogation once in 15 days. This submission is reasonable.

The application is allowed.

In the event of arrest in Crime 170/2020 registered with Rana Pratap Nagar Police Station, Nagpur the applicant shall be released on furnishing P.R. Bond of 25,000/- with a surety of like amount. Considering the ࣷ⨼ prevailing situation, the surety may be furnished within four weeks of the arrest.

The applicant shall attend Rana Pratap Nagar
Police Station on 1st and 3rd Saturday of the month from 10.00 a.m. to 1 p.m. till the filing of the chargesheet and shall cooperate with the Investigating Officer. 8.
The applicant shall not, directly or indirectly, make any attempt to influence the witnesses or otherwise tamper with the investigation.
9.
The applicant shall not leave the country without the permission of the trial Court.
