The accusation is serious.

The applicant allegedly stabbed to death his brother.

The version of the eye witnesses, who are all family members, is consistent and prima facie confidence inspiring. This, of course, is a observation made for the limited purpose of considering the present application.

Considering that the witnesses are close family members, including mother, sister and brother of the applicant, the possibility that the witnesses may be influenced or emotionally blackmailed cannot be excluded.

No case is made out for grant of bail at this stage. However, if there is no significant progress in the trial in the next six months, the applicant shall be entitled to approach the learned Sessions Judge for bail, afresh. 7.

The application is dismissed.
