Heard the learned Counsel for the rival parties.
The applicants have been prosecuted for the offences punishable under Sections 354-A(I) of the Indian Penal Code and Sections 7, 8, 9F, 10, 11 and 12 of the Prevention of Child from Sexual Offence Act in Crime No.149 of 2015.
It is not in dispute that the chargesheet has been filed before the competent Court by the Investigating agency. It is also not in dispute that the applicants have been in custody since 04-04-2015. The learned Counsel for the applicants further states that
both the applicants have been suspended.
In view of the above and looking to the fact that it is not possible to have the trial completed within a reasonable time, it would be proper to release the applicants on bail. Hence, the following order :- O r d e r A] Criminal Application (BA) No.294 of 2015 is allowed.
B] The applicants shall be released on bail on furnishing a PR bond of Rs.10,000/- each with one solvent surety in the like amount before the Competent Court.
C] The applicants to cooperate with the Investigating agency till commencement of the trial and as and when called by the IO.
