DATE : 16/06/2022 1] Mr. Takwale, learned counsel for the appellant has filed an undertaking dated 14.6.2022 on record, undertaking that henceforth the appellant shall appear before the learned Sessions Court on every date at 10.30 a.m along with his counsel without fail.
2] The undertaking is accepted as an undertaking to this Court.
3] In view of the said undertaking, in my considered opinion, the purpose for issuance of the non-bailable warrant and the order dated 30.4.2022 inasmuch as it directs the appellant/accused no.3 to show-cause why the amount of his forfeited P.R. bond should not be recovered from him, stands addressed and satisfied. So far as the question of non-bailable warrant is concerned, the appellant is already arrested and
20appeal305.22.odt released on bail subsequently on account of the order dated 6.5.2022 passed by this court.
4] Though it is opposed by learned APP, considering the undertaking given, the operative part no. 3 of the order dated 30.4.2022 is hereby quashed and set aside and the interim order dated 6.5.2022 granting ad-interim protection is hereby confirmed.
5] The appeal is allowed in the above terms. It is however made clear that any default in future shall not be countenanced by the learned Sessions Court.
