Heard Shri A.S. Dhore, learned counsel for the applicants, Shri S.A. Ashirgade, learned APP non-applicant No. 1 and Shri M.I. Dhatrak, learned counsel for nonapplicant No. 2. 2.

Perused the complaint lodged by non-applicant No. 2 and also perused the case diary and chit allegedly written by the deceased prior to his death.

Investigation is already over.

In this situation, at this stage, after going through the chit, we are not in a position to express finally either way on the contention that the story therein cannot constitute instigation.

As investigation is over and there is no question of any coercive steps now being taken against the applicants, we direct non-applicant No. 1 to present charge

After the charge sheet is filed, we grant the applicants liberty to move appropriate application seeking discharge before that court.

With these directions and observations, we dispose of the present application. No order as to costs. JUDGE JUDGE *GS.
