For the reasons mentioned in the application, Criminal Application (APPA) No.266 of 2015 is allowed. Delay is condoned.
Criminal Application (APPA) No.267 of 2015 This is an application filed by the wife of deceased accused no.8 Anjum wd/o Mufizmiya Bapumiya Deshmukh for bringing her name as appellant in place of her husband in Criminal Appeal No.
77 of 2014 that was filed by the husband who eventually died. This application has been filed because the police authorities have refused to grant
any pension to her as the appeal was dismissed as abated and he was not acquitted by the Court. I think that applicant/appellant Anjum wd/o Mufizmiya Bapumiya Deshmukh being the wife is entitled to represent him and is entitled to substitute in his place.
However, the learned APP is directed to find out the correctness of the statement that the applicant is the wife of accused no.8 Mufizmiya Bapumiya Deshmukh by making enquiry to the concerned Superintendent of Police (Rural), Amravati and place the report accordingly on the next date of hearing.
Criminal Application (APPA) No.267 of 2015 is allowed subject to the report receivable from the Superintendent of Police (Rural), Amravati.
The report must be placed on record on 05-07-2015. The learned Counsel for the appellant to supply all the copies of evidence, judgment etc.
to the learned APP before the returnable date.
