APRIL 27, 2018 Heard. Perused the reply of the prosecution and the charge-sheet.

As the charge-sheet has been filed, it is clear that custodial interrogation of the applicant is no longer required.

The total amount misappropriated by this applicant is alleged to be Rs.10, 50,074/-. Out of it, this applicant has deposited Rs. 3,32,320/- before filing of the FIR. Now, as submitted by the learned counsel for the applicant, the applicant has further deposited an amount of Rs.2,05,000/- before the Registrar of this Court. So the amount deposited by this applicant in total comes to Rs.5,37,320/-. The applicant assures this Court that he would be depositing remaining amount within a period of one year from the date of the order. This would show the bonafides of the

BA368.18 applicant. That being so and also the fact that, custody of the applicant is no longer required, I am inclined to allow the application and it is allowed accordingly.

It is directed that the applicant be released on bail on his furnishing PR bond of Rs.30,000/- with one solvent surety in the like sum, on following conditions.

(i) The applicant shall co-operate with the trial Court for expeditious disposal of the trial. (ii) The applicant shall fulfill the assurance given by him to this Court, within a period of one year from the date of order.

(iii) The applicant shall not tamper with the prosecution witnesses.

The application stands disposed of accordingly.
