Siras, Advocate for petitioner Shri P.K. Raulkar & Mrs. Indira Bodade, Advocates for respondent CORAM : SMT. VASANTI A NAIK AND KUM. INDIRA JAIN, JJ.

DATE : 30.08.2016 By this contempt petition, the petitioner seeks action against the respondent for wilful disobedience of the order, dated 21.8.2013 in Writ Petition No.499/2013.

It is stated on behalf of the petitioner that despite the specific directions to the Education Officer to decide the proposal of the petitioner for shifting of the school, the Education Officer has not taken a decision.

Shri Raulkar, the learned Counsel for the respondent states that the petitioner was heard on 30.6.2016 and after granting an opportunity of hearing, the Education officer has decided the proposal of the petitioner by the order dated, 30.6.2016. It is stated that a copy of the order is sent to the

Deputy director of Education for appropriate action and a copy of the decision - order is handed over to the Counsel for the petitioner in the Court today.

In view of the statements made on behalf of the respondent, it appears that though a little belatedly, the order stands complied with. If the petitioner is aggrieved by the decision of the Education Officer, the petitioner has other remedy. It would however not be proper to proceed with the contempt petition any longer.

The contempt petition is disposed of with no order as to costs.
