The applicant, apprehending arrest in connection with the crime registered by the non-applicant for the offence punishable under Sections 65(a) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, has sought pre-arrest bail.

The accusations against the applicant are that though sale of liquor in Chandrapur is prohibited, the applicant is supplying liquor for sale in Chandnrapur District and this is revealed during the investigation and on interrogation of the person from whom stock of liquor is seized.

The application is opposed on the ground that the investigation is in progress and custody of the applicant is required for investigation. The learned A. P. P. has submitted that the applicant is habitual offender and crimes for similar

2 aba247.17 offences are registered against him. The applicant had filed Criminal Application (ABA) No.134 of 2017 seeking pre-arrest bail in Crime No.220 of 2017 registered against him for the similar offence. This application is rejected by this Court by the order passed on 20th June, 2017.

Considering the above facts, I am not inclined to grant the prayer made in the application. The application is dismissed.
