Heard the learned Counsel for the applicant.

Issue notice to the non-applicant/State.

The learned A.P.P. waives notice on behalf of the State and files on record reply of the prosecution. Perused the reply of the prosecution. This is a case in which the only allegation is that this applicant sold plot of land twice to two different persons. Considering such nature of allegation, I do not think that the custodial interrogation of the applicant would be necessary, as whatever has been done by this applicant is a matter of record. In the circumstances, I am inclined to allow this application.

The application is allowed and it is directed that in the event of arrest of the applicant in Crime No. 64/2017 registered with Police Station Koradi, District Nagpur, the applicant shall be released on bail on his furnishing a P.R. Bond in the sum of Rs.30,000/- together with one solvent surety in the like sum, on the following conditions:

aba.239.18 2/2 i. The applicant shall attend the concerned Police Station everyday between 11:00 a.m. and 01:00 p.m. for a period of two weeks starting from 16th April, 2018 and also on such other occasions as may be required by the Investigating OfÏcer.

ii. The applicant shall furnish his phone numbers including mobile numbers and shall not leave India without prior permission of the Investigating OfÏcer, till the charge-sheet is filed.

iii.The applicant shall furnish his present address along with copies of Aadhar Card, PAN Card and other documents relating to residential proof to the Investigating OfÏcer on 16th April, 2018.

iv. The applicant shall co-operate with the Investigating OfÏcer in the investigation.

v. The applicant shall not tamper with the prosecution witnesses, in any manner.

The application is disposed of in the above terms.
