It is not is dispute that the applicant was arrested for the offences punishable under Sections 354(A) of the Indian Penal Code read with Section 8 of the Protection of Children from Sexual Offences Act. The investigation appears to have been completed. The only apprehension is that the applicant may again harass the victim girl and also to tamper the prosecution witnesses. This Court understands the worry of prosecution, hence, the following order is made.

ORDER

(i) Criminal Application (BA) No. 298/2015 is allowed.

(ii) The applicant be released on bail on his executing personal bond of Rs. 10,000/- with one solvent surety in the like amount.

2 ba298.15 (iii) The applicant shall not in any case enter the Gondia City except only on the date of appearance before the trial Court.

(iv) The applicant undertakes to reside at Medical Square, Nagpur. He shall report to the Police Station, Ajni, Nagpur once in a month on last Sunday between 11.00 a.m. to 4.00 p.m.

(v) In case, the applicant makes any attempt to tamper the prosecution evidence or harass the victim girl, the bail will be cancelled and the applicant shall be lodged in the jail till the trial is over.
