ATED : 21 ST JUNE , 2021 Though the contempt petition was made returnable today, the same is not on Board. Hence, taken on Board.

By the order dated 07.06.2021, bailable warrant was issued to secure the presence of the respondent no.1. C.A.N. No.81 of 2021 has been moved today seeking recall of that order by stating that on 26.02.2021 additional charge of the post of Joint Director of Higher Education, Nagpur was given to one Dr.Sanjay Thakare as the respondent no.1 was on medical leave. From 01.03.2021, Dr.Sanjay Thakare was holding the charge of the post of Joint Director of Higher Education, Nagpur. It is further stated that absence of the respondent no.1 on the returnable date was not deliberate and the same occurred in these circumstances. It is therefore prayed that the order dated 07.06.2021 be recalled. The respondent no.1 is present in Court today. Considering the reasons mentioned in the application which is duly sworn by the respondent no.1, the order dated 07.06.2021 is recalled and C.A.N. No.81 of 2021 is disposed of. CONTEMPT PETITION NO.12/2021.

Shri D.P. Thakare, learned Additional Government Pleader submits that affidavit on behalf of the present incumbent Dr.Sanjay Thakare would be filed during course of the day. Copy of the same be served on the counsel for the petitioner.
