By this petition, the petitioner challenges the action of the Nagpur Improvement Trust in not publishing the advertisements in the Marathi Dainik Newspaper "Mahasagar" published by the petitioner.
On hearing the learned counsel for the parties for a considerable time, it appears that there is a serious dispute in regard to the extent of the circulation of the daily newspaper "Mahasagar" and the readership thereof. We do not find anything in the Government Resolution, dated 31/08/2009 which compels the Nagpur Improvement Trust to issue advertisements in the newspaper published by the petitioner. Even otherwise, since serious disputed questions of facts arise for determination in this writ petition, it would not be possible for this Court to decide the factual issues involved therein, for considering the prayers made on behalf
wp2388.14 2/2 of the petitioner. The petitioner is free to avail the other remedy, if advised.
In view of the aforesaid, the writ petition is dismissed with no order as to costs.
The points raised in the petition are, however, kept open.
