CORAM : B.P. DHARMADHIKARI & M.G. GIRATKAR, JJ.
SEPTEMBER 07, 2018.
Heard Mrs. Gauri Venkatraman, learned counsel for the petitioners and Shri A.D. Mohgaonkar, learned counsel for respondent Nos. 1 & 3 for sometime. 2.
During arguments the parties point out that the original Writ Petition Nos. 1174 of 1994 and 1316 of 2001 itself needed proper amendment.
3.
The issue pertains to pension of employees who have superannuated from employment of erstwhile Maharashtra State Electricity Board.
4.
If that be the position, it is apparent that the case for contempt may not survive. However, without observing anything on merits of the controversy, we grant contempt petitioners leave to file appropriate petitions raising
0709cp124.18 necessary challenges.
5.
It is made clear that as demand appears to be pending since 1994, if said petitions are filed, the Court shall make efforts to decide it at the earliest. 6.
With liberty to file fresh petitions, the present contempt petitions are disposed of. No order as to costs. JUDGE JUDGE *GS.
