Shri Khajanchi, learned counsel for the petitioner has pointed out the affidavit filed by the respondent Suryakant S/o Sadashivrao Arade dated 23rd April, 2023 more particularly paragraph 4 of the said affidavit which reads thus:

"04) I say that hence in that view of the matter, the Respondent has now decided that for the sake of prosecuting Summary Suit No. 9/2009 presently pending on file of Hon. Joint Civil Judge, Jr. Div. Chandrapur, the Respondent shall not rely on the said Agreement of Sale dtd 12/06/2000."

Learned counsel for the petitioner submits that in view of the aforesaid mentioned statement of affidavit, on instructions, submits that petitioner does not want to press this present petition. Accordingly, writ petition is disposed of as withdrawn.
