OCTOBER 9, 2025 Counsel for petitioner submits that the prayer is restricted to the directions to the respondents to act strictly in accordance with Section 8 of the Maharashtra Animal Preservation Act, 1976 ("Act of 1976") 2.

Learned A.P.P. submits that Section 8 of the Act provides for entry, search, seizure and custody of cattle. It provides that police officer, not below the rank of Sub Inspector or any person authorised in that behalf by the State Government may, for the purpose of securing compliance of provisions, enter, stop and search any vehicle used or intended to be used for the export of cow, bull or bullock. 3.

Learned A.P.P submits that the officer in the present case, who has taken action is of the rank of Sub Inspector and, therefore, he is authorised to act in terms of Section 8 of the Act of 1976. 4.

We accept the statement.
