In Writ Petition No.7892/2019 this Court directed the Education Officer (Secondary) to consider whether the petitioner therein, Shri Vivek Keshavrao Patil was entitled to pension under the old pension rules or under the new pension scheme. The present petitioners in the contempt petition were added as respondent nos. 4 and 5 in that writ petition but the Court did not feel it necessary to hear them while passing the said order.

Shri V. A. Dhabe, learned counsel for the petitioners submits that by issuing an order dated 05.02.2021 the Deputy Director of Education has held that the present petitioners are responsible for the non-submission of the relevant document with regard to opening of DCPS account.

We find that the petitioner in Writ Petition No.7892/2019 has not made any grievance as regards non-compliance of the order passed in that writ petition. The present petitioners who represent the Management if aggrieved by the communication dated 05.02.2021 can always invoke appropriate jurisdiction for challenging the said communication.

9.CP167.21.odt 2 In that view of the matter we are not inclined to entertain the contempt petition. It is accordingly disposed of. It is open for the petitioners to raise a challenge to the order dated 05.02.2021, if so advised.
