Heard Mr. Chilotra, learned counsel for applicant and Mr. Madiwale, learned A.P.P. for non applicant-State. Perused the detailed reply filed on behalf of the prosecution. After hearing learned counsel for applicant, when this Court was about to dismiss application, Mr.Chilotra, learned counsel for applicant, submits that he has instructions from his client to withdraw the present application.

The application is dismissed as withdrawn.

The applicant is an under trial prisoner. He has right to get his trial decided expeditiously. Hence, it is expected from learned Judge of Court below to give preference to decide the matter expeditiously.

The order be communicated to the counsel appearing for the parties either on the e-mail address or on WhatsApp or by such other mode, as is permissible in law.
