Heard learned counsel for the appellants and learned Advocate for respondent Nos. 1 and 2. 2.

Learned Advocates submit that parties have settled their dispute. It is submitted that the proposed respondent No. 4 is also party to the settlement and he has also signed the consent terms. It is submitted that in order to give finality to the decision that could be passed by this Court it is necessary to add Raju Kute as respondent No.4. In view of the facts stated in the application, the application is allowed, as prayed for.

Mr Raju S/o. Kundlik Kute be added as respondent No.4 in second appeal.

The amendment be carried out within one week.

The civil application stands disposed of, accordingly.

Issue notice to newly added respondent No.4, returnable within two weeks.

Learned Advocate for respondent Nos. 1 and 2 submitted that there is mistake in the compromise recorded before the Mediator as to the number of the respondent and the same may be allowed to be corrected before the Mediator. The prayer is allowed.

The matter be placed before the mediator on 25.04.2024.
