Heard.

The applicant, apprehending arrest in crime registered against him and three others for offence punishable under Section 379 read with Section 34 of the Indian Penal Code, has sought pre-arrest bail. The accusations against the applicant are that he is in the business of transport, owning trucks and the stock of coal, noticed by staff of Local Crime Branch, was kept by the applicant to be transported illegally. The facts on record show that stock of coal is found at an open space.

This Court has granted protection to the applicant by order passed on 13th April, 2017 imposing condition that the applicant shall attend the police station and co-operate with the investigation. It is not the complaint of the non-applicant that the applicant has not attended the police station or has not co-operated

Considering the facts of the case, the order passed by this Court on 13th April, 2017 granting protection to the applicant is confirmed.

The application is allowed accordingly.
