Heard learned counsel Shri Meshram for the applicant and learned Additional Public Prosecutor Shri V.P.Maldhure for the State.

The applicant is apprehending his arrest in connection with Crime No.304/2020 registered with Sindewahi Police Station for offences punishable under Sections 65(A) and 83 of the Maharashtra Prohibition Act, 1949.

On 20.6.2020, during Nakabandi, complainant, who is a head constable in Local Crime Branch, Chandrapur, laid a trap along with other officers on getting a secret information. During the said, it was found that one Scorpio vehicle, which is alleged to be belonging to present applicant, was carrying liquor which is contraband in district .....2/-

Chandrapur. Driver of the said vehicle was Bharat Gedam who is already released on bail.

Admittedly, the applicant was not found present on the spot when the vehicle was intercepted. There is nothing on record, at this stage, to show that the applicant was knowing that in his vehicle the liquor is being transported. In view of this, I am not ready to give much importance to past criminal record of the applicant. 5.

Since the contraband is already seized and it was not from the present present, I am of the view that the applicant can be released on anticipatory bail on certain conditions. Consequently, I pass following order:-

ORDER

(1) The criminal application is allowed.

(2) Applicant-Avinash s/o Manohar Nawarkhede, in connection with Crime No.304/2020 registered with Sindewahi Police Station for offences punishable under Sections 65(A) and 83 of the Maharashtra Prohibition Act, 1949, be released on bail on he executing a P.R.Bond in the sum of Rs.15,000/- with one solvent surety of the like amount.

(3) The applicant is directed to attend the police station once in a week i.e. on every .....3/-

Sunday between 10:00 a.m. and 5:00 p.m., till chargesheet is filed.

With this, the criminal application stands disposed of accordingly.
