After arguing for sometime, Shri R.R.Vyas, learned Advocate for the appellant seeks permission to withdraw the appeal, however, prays for grant of liberty to move fresh application before the Sessions Court if the trial does not commence within four months from today, or after receipt of the report of the Chemical Analyzer, whichever is earlier. The request made by the learned Advocate for the appellant being reasonable, it is not objected to by the learned A.P.P. as well as Ms Deepali Sapkal, Advocate representing the respondent No.2.

The appeal is disposed as withdrawn with liberty to the appellant to move fresh application reiterating his request for grant of bail, before the Sessions Court if the trial does not commence within eight months, or after receipt of the report of the Chemical Analyzer, whichever is earlier.
