By this petition, the petitioner-accused has prayed that the respondents be directed to release him on parole for 30 days to attend marriage ceremony of his son.

Grievance of the petitioner at the time of filing of the petition was that his application requesting for grant of parole leave is pending and decision is not taken on it.

In response to the notice issued by this Court, learned A.P.P. has placed on record copy of

Order 1004wp294.19 order dated 10.04.2019, by which the respondent no.2 Deputy Inspector General of Prisons has granted parole leave of 5 days from 15.04.2019 till 19.04.2019 to the petitioner. In view of the order dated 10.04.2019 passed by respondent no.2, the prayer made in the writ petition is rendered infructuous.

The learned Advocate for the petitioner submitted that the petitioner is entitled to parole leave of 30 days.

The right of petitioner to challenge and seek modification of the order passed by respondent no.2 is kept open.

7.

The Writ Petition is disposed accordingly.

No costs.
