The present appeal is filed challenging judgment and order of conviction dated 10.3.2005 passed by learned III-Ad hoc Additional Sessions Judge, Akola in Sessions Trial No.165/2004 whereby the appellant was convicted for offence punishable under Section 498A of the Indian Penal Code and was directed to suffer rigorous imprisonment for 3 years and to pay a fine of 2000.

The present appeal was filed by the appellant through his Advocate Shri R.M. Daga and on 12.10.2018 since nobody was appearing before the Court this Court (Coram : P.N. Deshmukh, J.) issued Bailable Warrant against the appellant.

A report is filed before this Court. In the .....2/-

apeal193.05 6 report, it is stated that appellant-Vilas was found to be dead at Retiring Room of Bus Depot at Paratwada and accordingly AD was registered at Achalpur Police Station. Along with the report, statements of Sau. Kiran Prakash Tale and Prakash Omkar Tale are placed on record. Sau. Kiran is elder sister of appellant-Vilas and Prakash is her husband. Statements recorded by the Police Station Officer at Police Station Civil Line, Akola on 19.11.2018 reveal that appellant-Vilas expired at Paratwada.

In view of the report that appellant-Vilas is dead, the present appeal stands abated and disposed of accordingly.
