In this petition the challenge is raised to the interim relief granted by the Industrial Court vide order dated 8th June 2016, passed below Exh.U-2 in Complaint No.15 of 2016 and another order which is under challenge is dated 17th October 2018, whereby the interim directions were issued to include name of the respondent in Salary Bill and pay him the salary every month. 3.
Considering the date of the orders and the time lapsed after passing of the orders, coupled with the fact that this matter was never got circulated to obtain the necessary orders, I am of the opinion that instead of going into the merits of the matter the purpose would be served if the Industrial Court is directed to decide the complaint expeditiously. Accordingly, I pass the following order: i) The Writ Petition is disposed of.
2 107-WP2467-2022 ii) The Industrial Court is directed to decide the complaint, according to law, as expeditiously as possible and in any case before 31st May 2023. iii) It is made clear that the Industrial Court shall not influence by the observations made in both the impugned orders and decide the complaint independently as per law.
The writ petition is disposed of accordingly. No order as to costs.
