DATE : April 24, 2019 Heard Shri A. A. Naik, learned counsel for the petitioners and Ms K. Deshpande, learned Assistant Government Pleader for respondent Nos.2 to 4. In view of the order proposed to be passed, service on respondent No.1 is dispensed with.

The petitioners are aggrieved by the interim order dated 20/03/2019 passed by the Divisional Commissioner in an appeal preferred by the petitioners challenging their disqualification as Members of the Gram Panchayat. By the impugned order the effect and operation of the order dated 07/03/2019 has not been stayed.

After hearing the learned counsel for the petitioners and in view of the fact that the statutory appeal is pending with the respondent No.4, the interests of justice would be served by directing expeditious disposal of the said appeal.

4-WP-2940-19 2/2 Hence the writ petition is disposed of by directing the respondent No.4 to decide the appeal on its own merits by 15/06/2019 after giving an opportunity to the parties. The fact that the prayer to stay the order dated 20/03/2019 was refused shall not come in way of petitioners when the appeal is decided. All points are kept open.

The petitioners are at liberty to raise additional grounds in the appeal by seeking due permission of the respondent No.4.

No costs.
