The learned Counsel for the petitioner, on instructions, seeks leave to withdraw the present petition with liberty to file appeal under Section 30 of the Employees' Compensation Act, 1923, against the order impugned dated 09-08-2019 passed by the Commissioner under the Workmen's Compensation Act.

The petition is disposed of as withdrawn with liberty as sought.

The learned Counsel for the respondent submits that the respondent be permitted to withdraw the amount deposited by the petitioner pursuant to the order passed by this Court dated 10-10-2022. It would be open to the respondent to make such request before the Appellate Authority.
