Heard.

The applicant seeks pre-arrest bail, apprehending arrest in connection with crime registered against him and co-accused Aman Wankhede for offence punishable under Sections 3(25), 7(27) of the Arms Act. According to the investigating agency, one person disclosed that the applicant had handed over country made pistol to him to give it to co-accused Aman Wankhede and on this information crime is registered against the applicant. This Court has granted interim protection to the applicant by the order passed on 19th April, 2017 imposing condition that the applicant shall attend police station and co-operate with the investigating agency. The investigating agency has not complained that the applicant has not co-operated with

2 aba254.17 it. The applicant has stated that he is not involved in any other crime / offence. The non-applicant has not been able to show that custody of the applicant is required for further investigation. In the facts of the case, the order passed by this Curt on 19th April, 2017 granting protection to the applicant is confirmed. The application is allowed accordingly.
