Heard the learned counsel for the applicant and the learned APP for respondent No. 1. None for respondent No. 2, though appears to have been served.

This application is for grant of early hearing of the application filed for quashing of FIR, on the ground that one of the applicants herein has retired on superannuation and he is not paid any of the retiral benefits since the offence is registered and pending against him.

The learned APP submits that the

In that view of the matter and as the investigation which is stayed by this Court is of the crime registered on the basis of orders of the learned J.M.F.C., Akola, passed under Section 156(3) of the Criminal Procedure Code, the application is allowed and disposed of. Criminal Application No. 398 of 2014 be listed for final hearing in the week commencing from 08.07.2019.
