The applicant is arrested on 23.3.2016 in the crime registered against him for the offence punishable under Section 307 of the Indian Penal Code on the accusations that the applicant gave slap to the complainant and pushed him in the pyre of "Holi" because of which the complainant sustained burn injuries up to 30%.
With the assistance of the learned Advocate for the applicant and learned Additional Public Prosecutor for the non-applicant/State, I have examined the copy of the First Information Report and the say of .....2/-
ba335.16 the investigating officer filed before the Sessions Court. Considering the nature of incident, the nature of accusations against the applicant and the fact that the non-applicant has not been able to point out in the reply filed before the Sessions Court that the custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.
Hence, the following order :- The applicant having been arrested in Crime No.136 of 2016 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.20,000/- and one solvent surety in the like amount.
The application is allowed accordingly.
